Agent errors leading to immigration fines in Indonesia

Indonesian authorities are issuing shipowners with large immigration fines if procedures for off-signing crew are not followed fully.
We are aware of several instances where immigration authorities have levied fines. In all instances, the owner-appointed agents failed to fully comply with Indonesian Customs requirements, namely that they didn’t take the disembarking crew to the immigration check points (TPI/Tempat Pemeriksaan Imigrasi).
Instead, the disembarking seafarers were taken directly to the airport, where they were detained by the authorities for illegal entry into the country. Local correspondents have confirmed that this is a violation of immigration law and there is a there is the potential sanction of one year imprisonment and/or a fine of IDR 100,000,000 (approx. USD 7,000) per person.
Additionally, there are potential criminal sanctions for the ship owner also.
Members should conduct full due diligence prior to appointing any agent in Indonesia.
